Legal Note: This is not legal advice, but rather guidelines based on the current regulatory activity in the European Union (EU), the United Kingdom (UK), Brazil (BR) and NextRoll’s services. The guidelines may change over time to reflect updated best practices. You should consult with your own counsel, privacy professionals and/or internal resources to determine a comprehensive and appropriate cookie consent solution for your business and your marketing activities.
What is a Cookie Consent Banner
To comply with European and Brazilian law you must gather consent on your website before tracking any visitors from either of these two geographic locations. To show ads in either Europe or Brazil, you will need to make sure your company complies with various privacy laws, including the EU and UK General Data Protection Regulations (collecting and processing the data collected through the cookie), the ePrivacy Directive (consent to drop cookies) and Brazilian Data Protection Law, the Lei Geral de Proteção de Dados Pessoais (“LGPD”).
You must gather consent from your European visitors with a Cookie Consent Banner if:
- Your business is located in the EU, UK, or BR
- Your business is located outside of the EU, UK, or BR and at least one of the following applies to you:
- 10% or more of your website traffic is from EU, UK, or BR visitors.
- You target EU, UK, or BR visitors in your campaigns.
- You accept any EU, UK, or BR currency on your website.
- You translate your website into languages spoken in the EU, UK, or BR.
Consent gathered through a Cookie Consent Banner is shown to your visitors as follows:
- If your company is located in the EU, UK, or BR: the Cookie Consent Banner will show for all your visitors.
- If your company is located outside of the EU, UK, or BR: the Cookie Consent Banner will only show for visitors with a European or Brazilian IP address.
Please note:
When a Cookie Consent Banner is implemented the NextRoll pixel will not track users who have not granted consent.

Cookie Consent Banner choices
The RollWorks platform gives you three different Cookie Content Banner choices:
OPTION 1. Use NextRoll's Cookie Consent Banner |
🏆 This is our recommended option. Deploys automatically. When you choose our Cookie Consent Banner, it will be implemented automatically through the same code you use to place your Pixel. Learn more here. |
---|---|
OPTION 2. Use a Custom Cookie Consent Banner |
Requires approval and can take several days to deploy. Learn more here. |
OPTION 3. No Banner |
You won't track visitors in any European country or any Brazilian state. |
Option 1. NextRoll’s Cookie Consent Banner
🏆 Our recommended option is to use the NextRoll Cookie Consent Banner, which can be automatically implemented through your pixel code. This is a simple solution that doesn’t require much extra developer work and will be implemented without any additional work on your end other than selecting our banner in your dashboard.
Our banner is available in English, Dutch, French, German, Italian, Japanese, Spanish, and Portuguese (based on your visitors' browser language) and covers cookies directly related to NextRoll's services.
Learn more about how to implement the NextRoll Cookie Consent Banner here.
Option 2. Custom Cookie Consent Banner
A custom banner or a third-party banner might be the right choice for you if you have other tracking banners, especially banners that use cookies on your site.
Below are some supported third-party Cookie Consent Banners:
We’ve compiled our suggested best practices to implement a Custom Cookie Consent Banner if you choose to use a third-party consent banner or your own consent banner.
In addition, we strongly recommend using a Cookie Consent Banner (also called a "consent management platform" or "CMP") that integrates with the IAB Europe Transparency & Consent Framework and is configured properly to meet our criteria.
You can learn more about the February 2022 Belgian Data Protection Authority decision on the IAB’s Transparency and Consent Framework and how this decision may impact NextRoll customers here.
Potential delays when using a custom banner
If you choose to use a custom banner or a third-party banner, we may require a review period and approval before your banner can go live.
Option 3. No Banner
If you choose not to implement a Cookie Consent Banner on your website, RollWorks will not track any traffic from EU, UK, or BR visitors and you will not be able to target these visitors with advertising.
